Terms of Service

1. Agreement to Terms

By creating an account or using Feedbacked (“the Platform,” “we,” “us,” or “our”) at feedbacked.org, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

These Terms constitute a legally binding agreement between you and Feedbacked, a Florida-based company. They govern your use of the Platform regardless of whether you are a startup (“Client”) or a tester (“Tester”).

2. The Platform

Feedbacked is a two-sided marketplace that connects Clients — companies or individuals who want real users to test their products — with Testers who complete product surveys in exchange for payment. We use automated systems to verify that each survey response was submitted by someone who genuinely used the product being tested. Responses that fail verification are discarded and replaced at no additional cost to the Client.

3. Eligibility

You must be at least 18 years of age to use the Platform or receive payments through it. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are registering on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration

You must provide accurate, complete, and current information when creating an account. Upon registration, we will send a verification email to the address you provide. You must verify your email address to activate your account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You may not create more than one account, share your account with others, or create an account on behalf of another person without their authorization. We reserve the right to suspend or terminate accounts that we believe are duplicates, fraudulent, or otherwise in violation of these Terms.

5. Prohibited Products

Clients may not submit the following types of products or services for testing on the Platform under any circumstances:

Malware, spyware, or stalkerware — any software designed to harm, surveil, or deceive users without their knowledge.

Adult or pornographic content, including platforms or apps whose primary purpose is explicit sexual material.

Gambling or sports betting products, including apps that facilitate wagering of real money.

Cryptocurrency, NFT, or speculative investment schemes, including platforms whose primary function is the promotion or sale of digital assets or unregulated financial instruments.

Multi-level marketing (MLM) or pyramid schemes, or any product whose business model requires participants to recruit others in order to earn.

Products that collect Tester personal data without clear disclosure, including any app or service that silently harvests information from Testers’ devices or accounts.

Weapons, controlled substances, or regulated goods, including platforms that facilitate the sale or distribution of firearms, drugs, or other legally restricted items.

Products primarily targeting minors, including apps, games, or services designed for or marketed to users under 18.

Phishing sites, scams, or fraudulent services of any kind.

If your product has features behind a paywall, all survey questions must be fully answerable without requiring Testers to make any purchase or spend their own money. Testers are never obligated to pay to complete a survey. Surveys that cannot be reasonably completed without a financial commitment from the Tester are subject to immediate removal.

We reserve the right to reject or remove any product from the Platform at our sole discretion, including products not explicitly listed above, if we determine they are harmful, deceptive, or otherwise inappropriate.

6. For Clients

Survey creation. When you create a survey, you provide a link to your product, custom questions for Testers to answer, and audit questions — hidden verification checks that only someone who genuinely used your product can answer correctly. You are responsible for ensuring your product is legal, functional, and accessible to Testers, and that all questions can be answered without requiring Testers to spend money or create paid accounts.

Payments and pricing. You pay per verified response at the rate published on the Platform at the time of your order. Feedbacked reserves the right to modify its pricing at any time without notice. Price changes do not affect orders already placed. All payments are processed at the time of order. Responses that fail our verification process are replaced at no additional cost.

No refunds. Because each verified response represents real work performed by a Tester and real platform processing, all sales are final. Refunds are not issued except at our sole discretion in cases of clear platform error.

Chargebacks and payment disputes. If you have a concern about a charge, you agree to contact us at support@feedbacked.org before initiating a chargeback or payment dispute with your card issuer or bank. We will make a good-faith effort to resolve your concern promptly. Initiating a chargeback without first contacting us may result in immediate account suspension. Feedbacked reserves the right to contest any chargeback we believe to be invalid and to recover any associated fees.

Tester anonymity. Tester identities are never disclosed to Clients. You receive survey responses only — no name, email address, or other personally identifying information about the Tester is shared with you under any circumstances.

7. For Testers

How it works. You browse available surveys, select one, try the product linked in the survey, and complete the questionnaire. To receive payment, your response must pass our AI verification process, which confirms that you genuinely used and engaged with the product.

Payment. Verified responses are paid at the rate published on the Platform at the time the survey was made available. Payment is made via direct bank transfer through Mercury. You are responsible for providing accurate and valid bank account information. Feedbacked is not responsible for delays or failures caused by incorrect banking details you provide. Earned and verified balances do not expire.

Independent contractor status and taxes. You are an independent contractor, not an employee of Feedbacked. You are solely responsible for reporting and paying any taxes on income you earn through the Platform, including income tax and self-employment tax where applicable. Feedbacked does not withhold taxes on Tester payments. If you are a U.S. person and earn $600 or more through the Platform in a calendar year, Feedbacked is required by law to issue you a Form 1099-NEC and report that amount to the IRS. You may be required to provide us with a completed Form W-9 before your earnings can be paid out. Regardless of whether you receive a 1099-NEC, you are responsible for reporting all income earned through the Platform on your tax return.

Honest engagement. You agree to genuinely use the Client’s product and provide honest, thoughtful answers. Responses that are fabricated, AI-generated, copied, or that otherwise do not reflect genuine use of the product will be flagged by our verification system and will not be paid.

One response per survey. You may not submit more than one response to the same survey. Duplicate submissions are a violation of these Terms and may result in permanent account termination.

Forfeiture upon termination. If your account is terminated or banned for any reason, you forfeit all unpaid earnings at the time of termination, regardless of whether those responses had passed verification. Feedbacked has no obligation to disburse any pending balance to a terminated account.

8. Campaign Management

Campaign duration. Feedbacked makes every reasonable effort to keep a Client’s campaign active until all purchased verified responses have been delivered. Campaigns may be extended beyond their original estimated timeframe to fulfill the Client’s order. We reserve the right to pause, extend, modify, or permanently end any campaign at any time, at our sole discretion, with or without notice.

Campaign termination by Feedbacked. We may terminate a campaign for reasons including but not limited to: the Client has added questions that are inappropriate, offensive, or in violation of these Terms; audit questions are structured in a way that makes genuine completion impossible or unreasonably difficult; the product is inaccessible, broken, or requires Testers to spend money to use; the campaign cannot be reasonably completed with a reasonable number of available Testers; or the campaign poses a risk to Testers or to the integrity of the Platform. Where a campaign is terminated due to a Client’s violation of these Terms, no refund will be issued for unused responses.

Tester banning. We reserve the right to ban any Tester at any time based on poor response quality, repeated failed verifications, suspected fraud, duplicate account usage, or any other conduct we determine is harmful to the Platform or its Clients. Banned Testers forfeit all unpaid earnings and are not eligible to create new accounts.

Client banning. We reserve the right to ban any Client at any time, including for submitting prohibited products, adding harmful or inappropriate survey questions, engaging in conduct designed to harm or deceive Testers, initiating fraudulent chargebacks, or repeated violations of these Terms. Banned Clients forfeit access to all campaigns and are not eligible for refunds on unused responses.

9. Verification Disclaimer

Our AI verification system is designed to assess whether a Tester meaningfully engaged with a Client’s product before completing a survey. We make a genuine effort to ensure that only responses from Testers who actually used the product are delivered to Clients. However, we do not guarantee that every verified Tester used the product, that every verified response is accurate or useful, or that the feedback delivered will meet any specific expectation. Verification is a probabilistic process, and no automated system is perfect. By purchasing responses on Feedbacked, Clients acknowledge and accept this limitation. Feedbacked shall not be liable for the quality, accuracy, or usefulness of any individual response.

10. Identity Verification

Testers are required to complete identity verification through Stripe Identity before receiving payments. By completing verification, you consent to Stripe collecting and processing your identity documents in accordance with Stripe’s own privacy policy. Feedbacked receives only a pass/fail verification status from Stripe and does not retain copies of your identity documents.

11. Ownership of Survey Responses

All survey responses submitted through the Platform — including text, ratings, and any other content submitted as part of a survey — are owned by Feedbacked upon submission. By submitting a response, you assign to Feedbacked all right, title, and interest in that content, including any applicable intellectual property rights. Feedbacked may use, display, reproduce, or analyze survey responses for any lawful purpose, including delivering results to Clients and improving the Platform.

12. Prohibited Conduct

You agree not to:

• Submit fraudulent, fake, or deliberately misleading survey responses.

• Attempt to game, manipulate, or circumvent the AI verification system.

• Create multiple accounts to earn additional payments or access additional surveys.

• Use automated tools, bots, or scripts to interact with the Platform.

• Submit products for testing that violate Section 5 of these Terms.

• Attempt to identify, contact, or solicit any anonymous Tester or Client through information obtained on the Platform.

• Initiate a chargeback without first contacting Feedbacked support as required by Section 6.

• Reverse-engineer, scrape, or copy any part of the Platform.

• Use the Platform in any way that violates applicable law.

13. Suspension and Termination

We may suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we determine, in our sole discretion, that your account poses a risk to the Platform or its users. Clients whose accounts are terminated forfeit access to any campaigns in progress. Testers whose accounts are terminated forfeit all unpaid earnings as described in Section 7.

You may close your account at any time by contacting us. Closing your account does not entitle you to a refund of any amounts paid. Testers who voluntarily close their account while verified earnings are pending must contact support to arrange any outstanding payout.

14. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not endorse, guarantee, or take responsibility for any product submitted by a Client for testing.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Feedbacked and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of data, arising out of or related to your use of the Platform. Our total liability to you for any claim shall not exceed the greater of (a) the total amount you paid to Feedbacked in the single month preceding the claim, or (b) $50 USD.

16. Indemnification

You agree to indemnify and hold harmless Feedbacked and its owners, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any third party’s rights.

17. Force Majeure

Feedbacked shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government action, internet or infrastructure outages, payment processor downtime, or any other event outside our reasonable control. In such circumstances, our obligations will be suspended for the duration of the event. We will make reasonable efforts to resume normal service as soon as practicable.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

20. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will post the updated Terms on the Platform and update the “Last updated” date above. Continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
