Terms of Service

1. Agreement to Terms

By accessing or using the Feedbacked platform, website, and related services (collectively, the “Service”) operated by Feedbacked (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update or modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

Feedbacked is a platform that connects businesses (“Clients”) with real users (“Testers”) who test digital products and provide feedback. Our AI verification system evaluates Tester responses to determine whether a Tester genuinely engaged with the Client’s product. Clients only receive and are charged for responses that pass our AI verification process. Responses that fail verification are discarded and replaced automatically at no additional cost to the Client.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration

To use certain features of the Service, you may be required to provide personal information including your name, email address, company name, and phone number. You agree to provide accurate, current, and complete information during the registration process and to keep your information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. SMS Verification and Communications

As part of the Service, we use SMS-based phone number verification to uniquely identify users and prevent duplicate submissions. By providing your phone number and checking the consent checkbox on our verification form, you expressly consent to receive one-time SMS verification codes from Feedbacked. These messages are transactional in nature and are used solely for identity verification purposes. No marketing or promotional messages will be sent via SMS. Standard messaging and data rates from your mobile carrier may apply. You may contact us at any time to request removal of your phone number from our records.

6. Client Terms

If you are using Feedbacked as a Client (a business purchasing user testing services), the following terms apply:

Pricing and payment. You agree to pay the fees associated with the testing package you select. All prices are listed in US dollars. Payment is due at the time of purchase. All sales are one-time transactions unless otherwise specified. We do not offer subscription-based billing.

Verified responses. You will receive the number of verified responses specified by your selected package. Our AI verification system determines whether a Tester’s response demonstrates genuine engagement with your product. Responses that fail verification are replaced at no additional cost. The determination of whether a response passes or fails verification is made by our AI system and is final.

Use of results. You retain full ownership of the feedback data and insights delivered to you through the Service. You may use this data internally for product development, research, and decision-making. You may not resell or redistribute raw Tester responses.

7. Tester Terms

If you are using Feedbacked as a Tester (an individual providing feedback on a Client’s product), the following terms apply:

Honest engagement. You agree to genuinely use the Client’s product and provide honest, thoughtful responses to all questions. Responses that are fabricated, copied, generated by AI, or that do not demonstrate genuine use of the product may be flagged by our verification system and discarded.

Compensation. Testers are compensated for responses that pass our AI verification process. Compensation amounts and methods will be communicated to you prior to each testing session. Responses that fail verification are not eligible for compensation.

8. Intellectual Property

All content, design, code, graphics, logos, and other materials on the Service are owned by or licensed to Feedbacked and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our materials without prior written consent. Client products shared with Testers through the Service remain the intellectual property of the respective Client.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.

• Attempt to circumvent, disable, or interfere with our AI verification system.

• Create multiple accounts or use false information to submit duplicate responses.

• Use automated tools, bots, or scripts to interact with the Service.

• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.

• Harass, abuse, or harm other users of the Service.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. While our AI verification system is designed to filter out low-quality responses, we do not guarantee that every verified response will meet your specific expectations or requirements.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Feedbacked and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service, regardless of the cause of action or the theory of liability. Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Feedbacked and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Feedbacked is incorporated, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
